Terms of Service
These Terms of Service ("Terms") form a binding agreement between you and Lars Prins, developer of the AiKCalify mobile application ("AiKCalify", "we", "us"). By downloading, installing or using AiKCalify you agree to these Terms. If you don't agree, please don't use the App.
1. Eligibility
You must be at least 13 years old (or 16 in the EEA/UK) to use AiKCalify. If you have, or are recovering from, an eating disorder or any medical condition affected by diet, please consult a qualified clinician before using the App.
2. The service
AiKCalify is a personal nutrition-tracking app that estimates calories and macronutrients from photos of meals using AI, syncs with Apple Health, and tracks weight and activity. Some features are free; others require a paid subscription (see §4).
3. Health and AI disclaimer
AiKCalify is not a medical device and does not provide medical advice. Calorie and nutrient estimates produced by the AI are approximations and may be inaccurate. The App's daily targets, projections and reminders are guidance only — they are not a substitute for advice from a registered dietitian or physician.
Don't use AiKCalify to diagnose, treat or manage any medical condition. If you experience symptoms of an eating disorder or other health concern, stop using the App and seek professional help. Resources are listed in the App under Profile → Resources, and on this Support page.
4. Subscriptions, trials and pricing
4.1 Subscription
AiKCalify offers an auto-renewing annual subscription that unlocks premium features ("AiKcalify Pro"). The price shown in the App is in your local currency and is the binding price.
4.2 Free trial
New users may be offered a 3-day free trial. If you don't cancel at least 24 hours before the trial ends, your subscription will automatically convert to a paid subscription at the displayed price.
4.3 Renewal
Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the renewal date. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
4.4 Managing or cancelling
Manage or cancel your subscription in iOS Settings → [your name] → Subscriptions, or directly in the App Store. Uninstalling the App does not cancel your subscription.
4.5 Refunds
All purchases are made through Apple. Refund requests are handled by Apple under their refund policy. We do not control refunds and cannot issue them directly. Where required by law (including the 14-day right of withdrawal for EU consumers), Apple offers a refund mechanism via reportaproblem.apple.com.
4.6 Price changes
We may change prices for future billing periods. Apple will notify you and ask you to confirm continuation before charging the new price, as required by the App Store rules.
5. Your account and content
You're responsible for any data you enter into the App and for keeping your device secure. You may delete any meal, weight or activity entry at any time from within the App. Uninstalling the App removes all local data; subscription state can be restored via the Restore Purchases option after re-install.
6. Acceptable use
You agree not to:
- Reverse-engineer, decompile or attempt to extract the source code of the App, except to the extent expressly permitted by law.
- Use the App to upload illegal, infringing or harmful content.
- Use the App in any way that interferes with our servers or other users.
- Resell, sublicense or commercially redistribute the App or any part of it.
- Use the App's AI to attempt to extract training data or override safety constraints.
7. Intellectual property
The App, including its design, code, text, graphics and trademarks, is owned by Lars Prins and protected by copyright and other intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, in accordance with the App Store Terms of Service and these Terms. All rights not expressly granted are reserved.
8. Third-party services
AiKCalify uses third-party services including Apple App Store, Apple HealthKit, OpenAI, RevenueCat, Google Firebase, Meta and TikTok. Your use of those services is also subject to their respective terms.
9. Privacy
Your use of the App is also subject to our Privacy Policy, which is incorporated into these Terms by reference.
10. Disclaimer of warranties
To the maximum extent permitted by law, the App is provided "as is" and "as available", without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy of AI output, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that defects will be corrected.
Nothing in these Terms excludes liability that cannot be excluded by law, including, where applicable, statutory consumer rights under EU consumer law or the UK Consumer Rights Act 2015.
11. Limitation of liability
To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenues, data or goodwill, arising out of or in connection with your use of the App. Our total aggregate liability for any claim arising out of or relating to the App will not exceed the amount you paid to Apple for the App in the 12 months preceding the event giving rise to the claim, or €50, whichever is greater. This clause does not limit liability for death, personal injury caused by negligence, or fraud.
12. Indemnity
You agree to indemnify and hold us harmless from any claim, loss or expense (including reasonable legal fees) arising from your breach of these Terms or your misuse of the App, except where such claim is caused by our negligence or wilful misconduct.
13. Termination
We may suspend or terminate your access to the App if you materially breach these Terms. You may stop using the App at any time by uninstalling it. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law) will do so.
14. Changes to these Terms
We may update these Terms from time to time. If changes are material, we'll update the "Last updated" date and, where appropriate, notify you in-app. Continued use after the changes take effect means you accept the new Terms.
15. Governing law and disputes
These Terms are governed by the laws of the Netherlands, without regard to conflict-of-laws principles. Disputes will be heard exclusively by the competent courts of Amsterdam, the Netherlands — except that consumers may also bring proceedings in the courts of their own country of residence, and may have access to mandatory consumer-protection rules of that country.
EU consumers may also use the European Commission's Online Dispute Resolution platform.
16. Apple-specific terms
You acknowledge that these Terms are between you and us, not Apple, and Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple is a third-party beneficiary of these Terms and is entitled to enforce them against you.
